1. Introduction
1.1 These Terms & Conditions of Sale ("Terms") apply to all purchases of products ("Products") made through our website (the "Site").
1.2 The Site is operated by Martine Rose Studio Ltd, a company registered in England and Wales with company number 09917072 and registered office at C/O Sheridans, 76 Wardour Street, Fifth Floor, The Terrace, London, England, W1F 0UR ("we", "our", or "us"). Our VAT number is GB230280158.
1.3 By placing an order on our Site, you agree to be bound by these Terms and any policies or documents referred to herein.
2. Eligibility
2.1 You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
2.2 By placing an order, you confirm that you meet this requirement.
3. Products
3.1 Product descriptions, images and specifications are provided for illustrative purposes only. While we aim for accuracy, slight variations may occur.
3.2 Availability of Products cannot be guaranteed. We reserve the right to withdraw items at any time.
4. Ordering Process
4.1 Your order constitutes an offer to purchase Products from us. We will confirm acceptance by email ("Order Confirmation").
4.2 We reserve the right to reject or cancel any order, including in cases of stock unavailability, suspected fraud, or payment failure.
5. Pricing & Payment
5.1 Prices are displayed in GBP, or in local currency where available. Sales tax, VAT will be calculated at checkout.
5.2 Shipping costs, duties, and import taxes may be included at checkout (Delivered Duty Paid – DDP) or payable on delivery (Delivered Duty Unpaid – DDU), depending on your location and the method selected.
5.3 Payment must be made by the methods shown at checkout. By submitting payment information, you authorise us and our third-party providers to process your payment.
6. Delivery
6.1 Delivery times and costs will be displayed at checkout. These are estimates and not guarantees.
6.2 We are not responsible for delays outside our control, including customs delays, strikes, or courier issues.
6.3 Risk of loss and title for Products pass to you on delivery.
7. Customs Clearance and Brokerage
7.1 For certain countries, including but not limited to Brazil, Morocco, Egypt, French Guiana, Ecuador customers may be required to act as the importer of record and assume responsibility for customs clearance. This may include providing personal identification numbers, paying any applicable duties/taxes, and acting as the broker (or appointing a licensed broker) to release the shipment from customs. We are not responsible for delays, additional costs, or the return of goods due to a customer’s failure to fulfill these obligations.
8. Pre-Orders
8.1 From time to time, we may offer Products on a pre-order basis. Estimated delivery times for pre-order items will be indicated on the Site.
8.2 Pre-order Products are subject to production schedules and may be delayed. If there is a significant delay, we will notify you and you may cancel for a refund.
9. Cancellation Rights
9.1 You have a legal right to cancel your order within 14 days of delivery.
9.2 To exercise this right, you must notify us within the 14-day period by email at customercare@martine-rose.com using the model cancellation form provided below.
9.3 You must then return the Products to us within 14 days. You are responsible for the cost of return shipping.
9.4 We aim to refund you within 14 days of receiving the returned Products, using the same payment method you used for the transaction.

10. Returns & Refunds
10.1 Products must be returned in original condition, unworn, and with all tags attached.
10.2 Refunds will be made to the original payment method within 14 days of receipt of returned Products, subject to inspection and bank operating times.
11. Faulty or Misdescribed Products
11.1 If a Product is faulty, damaged, or misdescribed, you may be entitled to a repair, replacement, or refund in accordance with your statutory rights.
11.2 This applies regardless of your location (UK, EU, US, Australia, or Asia-Pacific).
12. Our Liability
12.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
12.2 We are not liable for business losses (including loss of profit, revenue, goodwill, or opportunity). We are only responsible for losses that are a foreseeable result of our breach of these Terms.
12.3 To the fullest extent permitted by applicable law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not warrant that the Site, its content, or the Products will meet your requirements, be uninterrupted, timely, secure, or error-free.
12.4 Our maximum liability to you in connection with any order will not exceed the total price paid for the Products.
12.5 Some jurisdictions (including certain US states and Australian states) do not allow limitations on implied warranties or the exclusion/limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
13. Governing Law & Jurisdiction
13.1 These Terms and any disputes shall be governed by English law, and the courts of England and Wales shall have non-exclusive jurisdiction.
13.2 If you are a US customer, you also benefit from mandatory US consumer rights. Nothing in these Terms affects those rights.
13.3 If you are an Australian customer, you benefit from the Australian Consumer Law, which provides guarantees that cannot be excluded. Nothing in these Terms affects those rights.
13.4 If you are a customer in Asia-Pacific (excluding Australia), you may also benefit from mandatory local consumer rights that cannot be excluded. Nothing in these Terms affects those rights.
14. Dispute Resolution (US Customers)
14.1 If you are a US customer, you agree that any dispute arising out of or in connection with these Terms or your purchase shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if eligible.
14.2 You agree that you may only bring claims against us in your individual capacity, and not as a plaintiff or class member in any class or representative action.
14.3 Arbitration will be administered by the American Arbitration Association (AAA) under its rules. The seat of arbitration shall be New York, NY
15. General
15.1 We may update these Terms from time to time. The version published on our Site at the time of your order will apply to your purchase.
15.2 If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
16. Third-Party Providers
16.1 We may use third-party providers for payment processing, shipping, and other services. Your use of such services may be subject to additional terms and privacy policies provided by those third parties.
